Trade mark filling stages
Stage 1 : Pre-filing a trade mark
- Ensure that your trade mark of choice meets all the legal requirements for registration.
- Make sure the trade mark is easy to read, write, spell and remember and is suitable to all types of advertising media.
Stage 2 : Trade mark search
(This service is optional, but it is highly recommended)
- Our agent will do a trade search to make sure that it is not identical or confusingly similar to existing trade marks.
- Based on the result of the trade mark search, we will evaluate the chance of registering your choice of trade mark.
Stage 3 : Filling an application
Stage 4 : Advertisement in the Government Gazette
- After formal and substantive examination on the trade mark, an application will be published in a journal with a set period of time for third parties to oppose its registration. In Malaysia, the trade mark will be advertised for 2 months.
Stage 5 : Opposition (if any)
Stage 6 : Certificate of Registration
- If there is no opposition filed before the expiration of the period for opposition, the Certificate of Registration will be issued. A successful application of a trademark is generally valid for 10 years from the filing date.
Stage 7 : Renewal of a Certificate
- The trade mark may be renewed every 10 years from the filing date by paying the required renewal fees.
