Industrial Designs

 

An industrial design is defined under the Malaysian Industrial Designs Act 1996 to mean features of shape, configuration, pattern or ornament applied to an article by an industrial process or means.

 


Apart from being new in the sense that it has not previously been registered or published in Malaysia prior to the date of application for registration, an industrial design must have eye-appeal. However, this does not mean that the article to which an industrial design is applied cannot be functional at the same time. Examples would include mobile phones and motor vehicles which are designed to be visually attractive but yet are essentially functional items.

 


Registration of an industrial design is for a period of 5 years which is then extendible twice for a period of 5 years each. Once registered, the owner of an industrial design has the exclusive right to use the industrial design for the article covered by the registration.
